Why Your Legal Pathway Comes First

Important Legal Considerations

When planning a move or extended stay in Italy, certain cross-border matters are often overlooked.

Cross-Border Estate Planning

Many Americans are surprised to learn that a U.S. will alone may not be sufficient to administer assets located in Italy. While foreign wills can be recognized under Italian law, transferring Italian property, bank accounts, or other holdings often requires additional procedures through an Italian notary. In many cases, establishing a separate Italian will can simplify the process.

Viaita works with trusted legal professionals to help clients navigate these cross-border considerations. Our in-house legal counsel can assist in determining whether additional estate planning steps may be appropriate for assets held in Italy.

Emergency Assistance & Repatriation Coordination

While rare, unexpected events can occur when living or traveling abroad. In the unfortunate circumstance that a death occurs in Italy, families may face complex documentation requirements and coordination with local authorities, the U.S. Embassy, and international transportation providers.

Viaita coordinates directly with KRS, Inc. International Funeral Shipping, led by repatriation specialist Nancy R. Lepore. Nancy lives in Lucca while still overseeing the general operations of Kirk Removal Service, Inc. the United States division of KRS, Inc. For more than 50 years, Kirk Removal along with KRS, has compassionately assisted families and funeral homes with the careful coordination and transportation of remains to and from the United States.

Working with local authorities, consular offices, and transportation providers, KRS manages the documentation and logistical arrangements required for the return of remains or cremated remains to the U.S., ensuring families have experienced guidance during what can otherwise be a complex international process.

For questions regarding these considerations, Viaita can provide guidance and coordinate with the appropriate professionals when needed.
